FreeNSale (“Platform,” “we,” “our,” or “us”) is operated as a DBA in Los Angeles, California. This Privacy Policy explains how we collect, use, store, and protect your personal information when you use our Platform at freensale.com. The Platform currently operates throughout the United States and may expand to other countries, including Canada, in the future; if and when that occurs, we will update this Privacy Policy to address any additional requirements applicable to users in those countries.

By using the Platform, you agree to the collection and use of your information as described in this Privacy Policy. If you do not agree, please do not use the Platform.

2. Information We Collect

We collect the following categories of personal information:

A. Information You Provide Directly:

• Full name and username

• Mobile phone number (for SMS verification)
• Password (stored in encrypted form)
• Profile information you choose to provide
• Listing content including item descriptions, prices, categories, and photos or video links you upload
• Contact details you choose to include on a listing for buyers to reach you, such as a phone number, WhatsApp number, SMS number, or email address (in addition to, or instead of, the Platform’s internal chat)
• Location information for a listing or event, including a general area (city, state) or, if you choose to provide it, an exact street address
• Messages sent through the Platform’s internal communication system

B. Information Collected Automatically:

• IP address and approximate geographic location
• Precise device location, if you choose to use location-based features such as “Use my location” or “Near me” search, and grant permission through your browser or device (you can decline or later revoke this permission through your browser or device settings; declining does not affect your ability to use the Platform, though location-based search results may be less relevant)
• Browser type and version
• Device type and operating system
• Pages visited and features used on the Platform
• Date and time of visits
• Referring website or source
• Cookie data and similar tracking technologies (see Section 6)

C. Information from Third-Party Login Services:

• If you register or log in using Google or Facebook, we receive basic profile information such as your name, email address, and profile photo as permitted by your settings on those platforms
• We do not receive your passwords from these third-party services

3. How We Use Your Information

We use the information we collect for the following purposes:

• To create and manage your account
• To verify your identity via SMS or email
• To display your listings and facilitate communication between users
• To display approximate or, where you have chosen to provide it, exact location information on your listings so that other users can find items and events near them
• To power location-based search features such as “Near me”
• To store and serve photos, videos, and content you upload
• To send service-related notifications, security alerts, and account updates
• To analyze Platform usage and improve our services
• To detect and prevent fraud, abuse, and violations of our Terms of Use
• To comply with applicable legal obligations
• To respond to your inquiries and support requests

4. SMS Communications & TCPA Compliance

By providing your mobile phone number and registering on the Platform, you expressly consent to receive SMS text messages from FreeNSale for account verification and service-related notifications.

Message frequency may vary. Message and data rates may apply.

To opt out of SMS messages at any time, reply STOP to any message we send.

For help, reply HELP or contact us at info@freensale.com.

We do not send marketing SMS messages without your separate express written consent. Opting out of SMS will not affect your ability to use the Platform.

5. How We Share Your Information

We do not sell your personal information. We may share your information only in the following limited circumstances:

A. With Other Users: Information you choose to make public — such as your listings, profile name, listing location (city, state, or exact address if you chose to provide one), and any contact details you added to a listing (phone, WhatsApp, SMS, email) — is visible to other users of the Platform, including unregistered visitors. You are solely responsible for deciding what location and contact information to make public on a listing.

B. With Service Providers: We may share information with trusted third-party service providers who assist us in operating the Platform, including:

• Cloud hosting providers (servers located in the United States)
• Cloudflare (CDN, security, and performance services)
• Google and Facebook (for login authentication services)
• Mapping and geolocation service providers (to power location-based search and display maps)
• Analytics providers (for usage data analysis)
• SMS delivery providers (for account verification)

These providers are contractually obligated to protect your data and may only use it as directed by us.

C. For Legal Reasons: We may disclose your information if required by law, court order, or government authority, or if we believe disclosure is necessary to protect the rights, property, or safety of the Platform, its users, or the public.

D. Business Transfers: If the Platform is acquired, merged, or sold, your information may be transferred as part of that transaction. We will notify you of any such change via email or a notice on the Platform.

6. Cookies & Tracking Technologies

We use cookies and similar tracking technologies to operate and improve the Platform. Cookies are small data files stored on your device.

7. Data Storage & Security

Your data is stored on servers located in the United States. We use Cloudflare for CDN and security services, which may process data through its global network.

We implement reasonable technical and organizational security measures to protect your information, including encryption of passwords, HTTPS/SSL for data transmission, and access controls. However, no method of transmission or storage is 100% secure. We cannot guarantee absolute security of your data.

In the event of a data breach that affects your personal information, we will notify affected users as required by applicable law.

8. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services, comply with legal obligations, resolve disputes, and enforce our agreements.

If you delete your account, we will delete or anonymize your personal information within a reasonable time, except where retention is required by law or for legitimate business purposes such as fraud prevention.

Photos, videos, and content you upload may be deleted upon account deletion, subject to caching and backup retention periods.

9. Third-Party Links & Services

The Platform may contain links to third-party websites or integrate with third-party services (such as Google and Facebook for login, or embedded YouTube videos on listings). We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information.

10. Children’s Privacy (COPPA)

The Platform is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will promptly delete that information and terminate the associated account.

11. U.S. State Privacy Rights

FreeNSale operates throughout the United States. Residents of many states now have specific privacy rights under their state laws. We honor these rights for all eligible users regardless of which state they live in.

• Right to Delete — Request deletion of your personal information, subject to certain exceptions

C. All U.S. Residents

Regardless of your state, all users have the right to:

12. Your Choices & Rights

You have the following rights regarding your personal information:

13. Advertising & Audience Targeting

We may use certain user information to improve the effectiveness of our advertising on third-party platforms such as Facebook (Meta) and Google. Specifically, we may:

• Upload hashed user data (such as email addresses and phone numbers) to create Custom Audiences on Facebook and Google for targeted advertising
• Use Custom Audiences to create Lookalike Audiences — groups of new potential users who share similar characteristics to our existing users
• Upload offline conversion data to measure the effectiveness of our advertising campaigns

Important: All data shared with Facebook and Google for these purposes is transmitted in hashed (encrypted) form using industry-standard SHA-256 hashing. We do not share your raw personal data directly. Facebook and Google use this hashed data solely to match against their own user databases for advertising purposes and are bound by their own privacy policies and data use terms.

Under the California Consumer Privacy Act (CCPA), sharing data for cross-context behavioral advertising may be considered “sharing” of personal information. California residents have the right to opt out of this use of their data.

To opt out of your data being used for advertising audiences and offline conversions, contact us at info@freensale.com with the subject line “Opt Out of Advertising Use.” We will process your request within 15 business days. You can also submit a request directly via our Do Not Sell or Share My Personal Information page.

14. Future Email Communications

We do not currently send marketing email campaigns. If we introduce email marketing in the future, we will obtain your separate express consent before sending such communications. You will always have the ability to unsubscribe from marketing emails.

We may update this Privacy Policy from time to time. When we make material changes, we will update the “Last Updated” date at the top of this document and notify users via email or a prominent notice on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Privacy Policy.
