FreeNSale (“Platform,” “we,” “our,” or “us”) is operated as a DBA by an individual based in Los Angeles, California. The Platform is an online service that enables users to create a personal online garage sale page, within which a user may list pre-owned items for sale, list items offered free of charge, and announce dates and details of upcoming physical garage sale events. The Platform is available throughout the United States and may expand to other countries, including Canada, in the future.
By accessing or using the Platform, you agree to be bound by these Terms of Use. If you do not agree, do not use the Platform.
The Platform allows a registered seller to create one personal online garage sale page (with a unique URL), within which the seller may publish content under any or all of the following three categories:

The Platform does NOT participate in, facilitate, guarantee, or have any involvement in transactions, arrangements to meet, exchanges, or handoffs between users. The Platform is not a buyer, seller, broker, agent, auctioneer, payment processor, shipping provider, or escrow service, and does not process, transmit, hold, or guarantee any payment between users. All communication, negotiation, scheduling, meeting arrangements, item exchange, and payment (if any) are conducted solely and directly between the buyer and seller (or giver and recipient), entirely outside of the Platform and at their own risk. Users are solely responsible for deciding how, where, and when to meet, exchange items, and (if applicable) exchange payment.

Users must provide accurate, current, and complete information and are responsible for maintaining the security of their account credentials. By registering and providing your mobile phone number, you expressly consent to receive SMS text messages from FreeNSale for the following purposes:
Message frequency may vary. Message and data rates may apply. To opt out of SMS messages at any time, reply STOP to any message. For help, reply HELP or contact us at info@freensale.com. Opting out of SMS will not affect your ability to use the Platform.
We do not use SMS for marketing purposes without your separate express written consent.
Users may separately opt-in to receive marketing messages about new features, promotions, or offers. Opting out of marketing communications will not affect service-related notifications described in Section 5.
By uploading photos, text, video links, or any other content to the Platform (“User Content”), you represent and warrant that:
Photos, titles, descriptions, and any linked videos on a listing are provided solely by the seller. The Platform does not verify, edit, or guarantee that this content accurately represents the actual item, service, or event, and is not responsible for any discrepancy between a listing’s content and the actual item. Buyers are solely responsible for independently confirming an item’s condition and description before completing any transaction.
By uploading User Content, you grant FreeNSale a non-exclusive, royalty-free, worldwide license to display, store, reproduce, and distribute your content solely for the purpose of operating and promoting the Platform. This license terminates when you delete your content or account.
The Platform’s name, logo, design, and software are the intellectual property of FreeNSale and may not be used without prior written permission.
We respect intellectual property rights. If you believe content on the Platform infringes your copyright, please send a written notice to info@freensale.com including:
We will investigate and take appropriate action, including removal of infringing content. Repeat infringers may have their accounts terminated.
Sellers are solely responsible for:
Prohibited listings include but are not limited to: illegal items, counterfeit or stolen goods, weapons, hazardous materials, and fraudulent listings. The Platform reserves the right to remove any listing at its sole discretion.
“Reserved” Status. The Platform may allow a seller to mark an item or listing as “Reserved.” This status is an informational tool only, intended to help sellers and buyers track availability, and does not constitute a binding contract, guarantee of sale, or legal obligation on the part of the seller, the buyer, or the Platform. The Platform is not responsible for any dispute arising from a change in, removal of, or reliance on a “Reserved” status.
Right to Refuse Service and Publication. The Platform reserves the right, at its sole discretion and without obligation to provide a reason or prior notice, to: (a) refuse to publish, approve, or list any item, event, photo, or other content submitted by any user; (b) remove, edit, hide, or restrict the visibility of any previously published listing, event, or content at any time; and (c) refuse service to, or decline to allow the use of the Platform by, any individual or entity, for any reason or no reason, including but not limited to suspected violations of these Terms, applicable law, or for any other reason the Platform deems appropriate. This right applies regardless of whether the content or user otherwise complies with the guidelines in these Terms. The Platform is under no obligation to publish, retain, or continue hosting any content or account.

Payment Methods. The Platform may allow sellers to indicate which payment methods they accept (such as cash, Venmo, Zelle, PayPal, or others) as an informational field on a listing. This indication is provided solely by the seller and reflects the seller’s stated preference only. The Platform is not affiliated with, integrated with, or endorsed by any third-party payment provider, does not process, transmit, hold, or guarantee any payment, and has no visibility into or responsibility for any payment made between users. Users are solely responsible for verifying and completing any payment directly with the other party, at their own risk.
The Platform currently offers a free basic tier. The free tier is subject to limits on the number of listings, items, and/or photos that a user may post, and to other usage restrictions, as displayed within the Platform’s interface (including at the time of registration, listing creation, or in account settings). These limits may be introduced, changed, increased, decreased, or removed at any time at our sole discretion, without prior notice, and the current limits in effect at any given time are those displayed on the Platform rather than any specific figures stated in these Terms.
Additional paid features may be introduced over time, including but not limited to increased listing or photo capacity, enhanced visibility, featured placement, keyword-based search alerts or notifications when new listings matching a user’s saved search terms become available, or other premium services that expand a user’s ability to sell, promote, or discover items on the Platform. Any notifications sent as part of such features (including by email, SMS, or push notification) are subject to the applicable consent and opt-out provisions described in Sections 5 and 6.
When paid features are offered, separate terms, pricing, and refund policies will be provided at the time of purchase. All fees are non-refundable unless otherwise stated in writing.
Promotion of listings does not imply endorsement, verification, or guarantee of any kind by the Platform.
The Platform is not intended for use by individuals under the age of 13. By using the Platform, you represent that you are at least 13 years of age. Users between the ages of 13 and 18 must have parental consent to use the Platform. We do not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will terminate their account and delete associated data.
Personal data is collected to operate accounts, authenticate users, facilitate communication, ensure service security, and comply with applicable law. User data is not sold to third parties. It is shared with third parties only as legally required or as strictly necessary to operate the Platform.
Residents of many U.S. states have privacy rights under their respective state laws, including California (CCPA/CPRA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Texas (TDPSA), Florida (FDBR), Oregon (OCPA), and others. These rights may include the right to know what data is collected, request deletion or correction of your data, obtain a portable copy of your data, opt out of targeted advertising, and appeal denied requests. We do not sell personal data. To exercise any state privacy right, contact us at info@freensale.com with the subject line “State Privacy Request” and include your state of residence. We will respond within 45 days or within the timeframe required by applicable law.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE SERVICE.
We do not warrant the accuracy, completeness, or reliability of any listing, user content, or information posted on the Platform. We do not guarantee that the Platform will be available at all times or free from technical errors.
To the maximum extent permitted by applicable law, FreeNSale shall not be liable for:
Our total liability to any user for any claim arising from use of the Platform shall not exceed the amount paid by that user to the Platform in the twelve (12) months preceding the claim, or $100, whichever is greater.
You agree to indemnify, defend, and hold harmless FreeNSale, its owner, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively through binding individual arbitration, not in court, except as otherwise provided below.
Arbitration shall be conducted by a mutually agreed arbitration service under its applicable rules. The arbitration shall take place in Los Angeles County, California. Each party shall bear its own costs unless the arbitrator determines otherwise.
CLASS ACTION WAIVER: You agree that any dispute will be resolved on an individual basis only. You waive any right to bring or participate in any class action, collective action, or representative proceeding against the Platform.
Small Claims Exception: Either party may bring an individual claim in small claims court in Los Angeles County, California, if the claim qualifies under that court’s jurisdiction.
The Platform reserves the right to suspend or terminate any account at any time, with or without notice, for violations of these Terms, applicable law, posting of prohibited content, fraudulent activity, or any other reason at our sole discretion.
Users may request deletion of their account at any time by contacting info@freensale.com. Upon deletion, your listings and content will be removed, subject to any legal retention requirements.
We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this document. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
These Terms of Use are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Subject to the arbitration agreement in Section 17, any legal action shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
Language. These Terms of Use are drafted in English. The Platform, including user-generated listings and content, may be available or translated into other languages for convenience. In the event of any conflict or inconsistency between the English version of these Terms and any translated version, the English version shall control.
